Objective

2.3 To promptly implement changes in law and procedure.

Intent of the Objective

Tradition and formality can obscure the reality that both the substantive and procedural laws are subject to change. Changes in statutes, case law, and court rules affect what is done in the courts, how it is done, and by whom. District courts should implement necessary changes to law and procedure promptly and correctly.

4th JDC
The court Rules Committee changed/extended the time to object to hearing officer recommendations from three to five business days. The Rules Committee and hearing officers routinely kept the judges up-to-date on rule changes and new changes in the law. The court provided a well-stocked library and Westlaw computer-based research assistance. Changes in the law were also discussed at the regular civil judges meetings. Also, judges were encouraged to attend continuing legal education programs.
11th JDC
The 11th JDC reported that the judge provided local law enforcement with a two-hour seminar on updates and changes in the law.
14th JDC
The 14th JDC reported that the judges continually exchanged continuing legal education materials among each other and met with Probation/Parole, the District Attorney, and the Clerk of Court.
16th JDC
The court addressed changes in the law and legal procedure through its regular and special en banc meetings as a regular, on-going activity. Special guests were invited to regularly scheduled judges’ meetings to provide information to judges regarding law and procedure requirements.

Also, judges regularly attended Judicial College seminars and state and national programs regarding changes in the law and procedure. Hearing officers and law clerks are mandated to attend Bar Association and, where permitted, Judicial College seminars as well, to keep updated.

The St. Mary Parish Hearing Officer reviewed the changes in family law legislation and provided a synopsis of family law changes to the judges.
17th JDC
The 17th JDC judges participated in the Louisiana District Judges' Association legislative committee.
19th JDC
Judges, law clerks, court reporters all continued to comply with their profession's continuing education requirements. The court administrator participated in the Louisiana Court Administrators Association and (to some extent) the National Association for Court Management.
24th JDC
The 24th JDC Management Committee met monthly to discuss pertinent changes in laws and procedures. The Management Committee developed an implementation plan and made recommendations to the entire bench at the monthly en banc meetings. The 24th JDC law clerks met to discuss and circulate any changes in laws and/or procedures. The 24th JDC also subscribed to Louisiana Supreme Court Reports and disbursed them to all judges on the bench.
26th JDC
Judges of the 26th JDC regularly attended judicial conferences and local continuing legal education programs, where recent developments were presented and discussed. Additionally, the court administrator prepared and circulated an update on the acts of the legislature at the conclusion of the legislative session.
27th JDC
The 27th JDC updated its court rules.
32nd JDC
The 32nd JDC judges met on a monthly basis to discuss issues relating to the operation of the legal system. The judges discussed new laws or changes in law at these meetings.
33rd JDC
The judge attended judicial education which addressed changes in law and procedure and monitored legislative action regarding bills of interest.
34th JDC
The judges attended 34th JDC continuing legal education seminars that addressed the changes in the law and procedure. The materials were also circulated to each judge.
40th JDC
The judges discussed updates in law and procedure at regular and special en banc meetings.
East Baton Rouge Juvenile Court
Court Administration monitored legislation through the Louisiana Court Administrators' Association (LCAA) to communicate promptly all changes and procedures in the law to the appropriate and relevant parties.
