GOAL 5: PROTECTING JUDICIAL INDEPENDENCE


Objective

5.1 To vigilantly guard judicial independence while respecting the other co-equal branches of government.

Intent of the Objective

For the judiciary to be fair and impartial, it should develop and maintain its distinctive and independent status as a separate, co-equal branch of state government. It also must be conscious of its legal and administrative boundaries and be vigilant in protecting them. The judiciary has an obligation to promote and maintain its independence. While insisting on the need for judicial independence, the judiciary should promote and institutionalize effective working relationships with the other branches of state government and with all other components of the state’s justice system. Such cooperation and collaboration is vitally important for the maintenance of a fair, efficient, impartial, and independent judiciary, as well as for the improvement of the law and the proper administration of justice.

Additional actions taken by the courts to address this objective
1st Circuit
The court provided information to the legislative branch during organized meeting events and testimony at committee meetings of the legislature and to other advisory committees established to study the judicial branch. The court met en banc with various legislators to exchange information and identify and address areas requiring legislative attention or involvement.
