GOAL 3: TO PROVIDE DUE PROCESS AND EQUAL PROTECTION OF THE LAW TO ALL WHO HAVE BUSINESS BEFORE THE COURT; AND TO DEMONSTRATE INTEGRITY IN ALL PROCEDURES AND DECISIONS.


Objective

3.3 To give individual attention to cases, deciding them without undue disparity among like cases and upon legally relevant factors.

Intent of the Objective

This objective upholds the standard that litigants should receive individual attention without variation due to the judge assigned to the case or legally irrelevant characteristics of the parties. To the extent possible, persons similarly situated should receive similar treatment. The objective further recognizes that court decisions and actions must be in proper proportion to the nature and magnitude of the case and to the characteristics of the parties. Variations should not be predictable due to legally irrelevant factors, nor should the outcome of a case depend on which judge within a court presides over a matter. The objective relates to all decisions, including sentences in criminal cases, the conditions of bail, the amount of child support, the appointment of legal counsel, and the use of court-supervised alternatives to formal litigation.

Additional actions taken by the courts to address this objective
BATON ROUGE CITY COURT
The court maintained a standardized bail bond schedule and viewed offenders on video callout from parish prison, to review any requests to adjust bail requirements. The court continued to utilize standard Boykin language and provided for this language in communicating with individuals with limited English proficiency that came before the court, utilizing interpreting services when necessary. The court followed sentencing guidelines as prescribed by state and local law.
FRANKLIN CITY COURT
Franklin City Court scheduled hearing reviews on suspended sentences to ensure compliance with community service obligations or restitution obligations.
JEANERETTE CITY COURT
The court used a written plea of guilty form and written sentencing order.
JEFFERSON PARISH 1ST PARISH COURT
Court DWI trial dockets were prepared by giving attention to the personal driving record of the defendant, with the goal of producing sentences which were better tailored, within legal guidelines, to the circumstances of the defendants as individuals. In civil matters, judges handled each case individually by personally performing legal research.
JENNINGS CITY COURT
The court used staff and general public focus groups to solicit feedback on the court's equality and fairness in the treatment of court users.
LAFAYETTE CITY COURT
Even though the two judges in this court handle more than 40,000 cases each year, all decisions by the court were based on legally relevant factors, taking into account the specific facts of each case. The judges of the court continued to use web access to Westlaw, including on mobile devices and computers in all court rooms, to ensure that they applied legally relevant factors.
NEW ORLEANS MUNICIPAL COURT
Municipal Court continued to work with other criminal justice agencies to develop and discuss alternative sentencing programs.
VIDALIA CITY COURT
Since this court is a small, single-judge city court, every case, civil, criminal, or juvenile was given the judge's personal attention.
