GOAL 1: TO ESTABLISH A MORE OPEN AND ACCESSIBLE SYSTEM OF JUSTICE.


Objective

1.3 To give all who appear before the court reasonable opportunities to participate effectively without undue hardship or inconvenience.

Intent of the Objective

This objective focuses on how a court should accommodate participants in its proceedings, especially individuals with disabilities, with difficulty communicating in English, or with mental impairments. For example, courts can meet the objective through their efforts to comply with the programmatic requirements of the Americans with Disabilities Act and through the adoption of policies and procedures for ascertaining the need for and securing the services of competent language interpreters.

BATON ROUGE CITY COURT
The court maintained a list of qualified interpreters, approved by the judges, to provide interpreting services to court users with limited English proficiency. The court adopted a policy of selecting court interpreters from the list with priority given to those who are on the Supreme Court Interpreter Registry. First priority is given to those who have obtained Certification status, followed by those who are Registered, followed then by interpreters who have previously been approved by Baton Rouge City Court to provide interpreting services. The court has encouraged all of its interpreters to undergo the training provided by the Supreme Court for this purpose. The court requires all interpreters to sign that they will abide by the code of professional responsibility under the Supreme Court Administrative Rules, and has adopted this requirement by en banc order.

The court also utilized the new Interpreter Bench Card, provided by the Supreme Court, and maintained the card on the bench in each courtroom to aid judges in cases involving interpreter services. The interpreter oath was also maintained on the bench in each courtroom, for use as needed on individual cases.
JEANERETTE CITY COURT
The court included in the in-court colloquy information about access to justice for those with limited English proficiency, with court staff screening for individuals who did not comprehend or appeared unsure of a response. The court also made available the Request for Interpreter and Order, located in the Appendix 5.1B of the Uniform Rules for District Courts.
JEFFERSON PARISH 1ST PARISH COURT
The court updated courthouse lobby signs both in English and Spanish for bilingual patrons and employed five employees fluent in Spanish. These employees assisted defendants and provided general information.

Computer codes input by court minute clerks automatically generated appropriate notification for the appointment of interpreters when interpreter services were required. Further, Spanish-speaking probationers attended class to learn to speak and write the English language.
JEFFERSON PARISH 2ND PARISH COURT
The court continued to employ four employees on staff who are fluent in either the Spanish or Vietnamese language. One of these employees staffed the information counter in the main lobby.
LAFAYETTE CITY COURT
Lafayette City Court reported that it maintained Boykin forms in English and in Spanish. It continued to expand the list of qualified interpreters to include those who interpret French, Spanish, Vietnamese, Arabic, Swahili, Thai, and any other language that is needed. The court also regularly arranged for interpreter training.
NEW ORLEANS MUNICIPAL COURT
New Orleans Municipal Court used outside licensed interpreter agencies to provide necessary language services. The defendant/victim/witness notifies the court that an interpreter is needed and the court makes a request through the clerk's office.
NEW ORLEANS TRAFFIC COURT
The court maintained the automated court phone line information in both English and Spanish, and the court's web page can be displayed in several different languages. Also, the court continued to employ two full-time bilingual employees available for translation and made available an AT&T language line when needed for lesser-used languages.
SULPHUR CITY COURT
Sulphur City Court had its rights form prepared in Spanish to serve Spanish-speaking defendants.
VIDALIA CITY COURT
The Vidalia City Court judge continued to serve as a member of the Supreme Court's committee to develop a statewide interpreter system.
