Performance of the City and Parish Courts

Fiscal Year 2016 - 2017

Back

GOAL 3: TO PROVIDE DUE PROCESS AND EQUAL PROTECTION OF THE LAW TO ALL WHO HAVE BUSINESS BEFORE THE COURT; AND TO DEMONSTRATE INTEGRITY IN ALL PROCEDURES AND DECISIONS

Objective

3.3 To give individual attention to cases, deciding them without undue disparity among like cases and upon legally relevant factors

Intent of the Objective

This objective upholds the standard that litigants should receive individual attention without variation due to the judge assigned to the case or legally irrelevant characteristics of the parties. To the extent possible, persons similarly situated should receive similar treatment. The objective further recognizes that court decisions and actions must be in proper proportion to the nature and magnitude of the case and to the characteristics of the parties. Variations should not be predictable due to legally irrelevant factors, nor should the outcome of a case depend on which judge within a court presides over a matter. The objective relates to all decisions, including sentences in criminal cases, the conditions of bail, the amount of child support, the appointment of legal counsel, and the use of court-supervised alternatives to formal litigation.

Additional actions taken by the courts to address this objective
BATON ROUGE CITY COURT
The court maintained a standardized bail bond schedule and heard from defendants on video callout from parish prison to review requests to adjust bail requirements.
LAFAYETTE CITY COURT
The judges of the court continued to use web access to Westlaw on mobile devices and computers; computers are installed in all courtrooms. Even though the two judges of the court often handle upwards of 40,000 cases in a single year, they strove to make sure each decision was based on legally relevant factors and to take into account the specific facts of each case.
NEW ORLEANS MUNICIPAL AND TRAFFIC COURT
The court adopted a fines and fees schedule en banc.
RAYNE CITY COURT
All plea forms applicable to the court's jurisdiction were modified to include changes in the law that occurred within the last year.
